Will and Trust Repository In Illinois original wills and trusts can be deposited with the Secretary of State by lawyers who can no longer find the clients who made them. The representatives of deceased lawyers can also make the deposit. The Secretary of State keeps an index of the documents by the name of the person who made them and any other names by which that person is known. The index is public, but not the contents of the documents. When that person's death is shown to the Secretary of State by court order or death certificate, the Secretary of State can transmit the document to the clerk of the probate court where probate occurs. If no notice of death is ever given, the documents must be kept for at least 100 years. || Back
