Why Is It Required

There is no legal requirement for probate proceedings. However, they are required as a practical matter to change title to the decedent's assets from the decedent to his or her heirs or legatees. Without court appointment of an authorized person to deal with, people who hold the assets will not release them. For instance a bank will usually pay a decedent's bank account only to a court appointed executor or administrator.

Probate proceedings are also required to determine controversies over what is a valid will, who are the heirs, questions concerning whether the decedent or someone else owned property and any other question about which there may be disagreement.
