How Much Time Does It Take

The minimum period which creditors have to file claims is 6 months from the date of publication so the minimum theoretical time probate takes is 6 months plus whatever time it takes to get the notice published and whatever time it takes to close after the 6 months expires. Usually it takes a little longer because of problems in administering the estate. Any problem or litigation can prolong the process. In larger estates the estate tax returns are not due until 9 months after death and any audit of these returns takes longer still. In these estates the administration is usually kept open until the estate tax matters are resolved.
