CHICAGO PROBATE

Per Stirpes

When a disposition of property is made per stirpes the beneficiaries take as a class based on a common ancestor. For instance, where a decedent leaves property to descendants per stirpes the property is divided into equal shares for every child the decedent ever had who is still living or who has descendants who are still living. The descendants of a deceased child take the deceased child's share. As a result the grandchildren born to one child can get different shares from the grandchildren born to another child.
