Missing Heirs

The share of a missing heir of a probate estate is paid to the County Treasurer. The County Treasurer holds it and after 7 years it is presumed abandoned under the Unclaimed Property Act and paid to the State of Illinois. Claim can be made there if the heir appears.

If there is no probate estate then the holding period is governed by the Unclaimed Property Act and varies according to who is holding the property.
