How Can I Find Out If Someone Had a Will

Whoever has the will of an Illinois decedent is supposed to file it with the probate court clerk within 30 days after the death. Inquiry should be made there after 30 days.

Otherwise you should look through the decedent's possessions for the will or a safe deposit box key or bank records showing there is a safe deposit box. People should not keep wills in safe deposit boxes, but they do.

Look for the decedent's cancelled checks and see if there is a check to a lawyer. Then ask that lawyer if they have a will or if they prepared one. Sometimes a lawyer's name might appear on recorded documents affecting the decedent's real estate.

Ask anyone who had contact with the decedent what they know about a will.

If necessary a probate estate can be opened and the administrator of the estate can use legal process to get records and ask people questions under oath to investigate. This is expensive and usually is not productive unless there is already some strong indication that there is a will.
