$3,500 and up for lawyers fees plus costs. Simpler small estates where there are no problems can be probated for about $4,000. As the number and value of assets and debts and the number of people involved increases so do costs increase. Costs of $5,000 to $15,000 are more usual, exclusive of taxes, filing fees and costs, which are extra. Lawyers usually charge hourly fees for probate matters. Some charge lump sum fees determined at the end of the process and these fees often come out about the same as the total of the hourly charges. Experienced probate lawyers charge from around $200 per hour to well over $300 per hour. When there is no will or the will does not excuse bond for the executor, the executor or administrator will have to get a surety company to sign on his or her bond. This results in a yearly premium the amount of which depends on the size of the estate. Yearly premiums of $300 - $500 are usual for smaller estates. Yearly premiums in the thousands of dollars are common for larger estates. Probate fees and publication costs will be about $500 for most estates. || Back
